Under Utah’s criminal code 76-5-103, one person is found guilty of committing aggravated assault if he/she uses a dangerous weapon or any other means of force which will produce death or serious bodily injury. Assault is specifically when one person either intentionally acts in a threatening, aggressive manner that instills fear in another or when one makes an attempt to seriously harm an individual. Assault is generally elevated to aggravated assault in cases where a weapon is involved, someone has been gravely injured or there was an intent to severely injure.

Penalties for Aggravated Assault in Utah

In the state of Utah, aggravated assault cases are typically charged as a 3rd degree felony, unless the aggravated assault is coupled with serious bodily injury, in which case the charge is automatically increased to a 2nd degree felony offense. Depending on the level of offense, here are the maximum penalties:

  • 2nd Degree Felony: 1-15 years in prison, $10,000 fine.
  • 3rd Degree Felony: 0-5 years in prison, $5,000 fine
